Our privacy policy in a nutshell


1. We collect some personal data in order to deliver our services
Though the vast majority of the data in our system is water data, we also collect personal data, including names, email addresses and usage metrics.

2. We store your personal data securely
We take care to ensure that your personal data is stored in a secure manner. For instance, once you change your password, it is encrypted and stored safely, and is not accessible to anyone, including the team at Gybe. 

3. We use your personal data to improve your experience
We want to create the best possible service for you. To do so, we track your interactions with our Website and software services, including clicks, page views and logins, to better understand which parts of our platform are most and least useful to you. This helps us improve the usability of our platform, and to inform us on where to focus our new feature development efforts.

Privacy Notice

Flying Gybe Inc. (“Gybe,” “we,” “us,” “our,” etc.) provides customers with access to data about the quality of large and small watersheds (rivers, lakes and coastal areas) all over the world as immediately as possible. We combine our ground sensors and algorithms with satellite imagery to offer a detailed look at how bodies of water may be affected by both natural changes (such as increases in sediment and algae) and manmade pollutants – as they are happening.

Our web-based GybeMaps application is designed to help our customers, organizations around the world, understand current water quality and safety while balancing the needs of agriculture, aquaculture, forestry, tourism, industry, and energy development, and to do so with an accuracy that matches expensive and time-consuming lab tests. We want what you want: less hassle, healthy water.

Assessing the quality of water in this way requires that we collect limited personal data from the people who register for and use our services. We understand that such information needs to be collected, protected, shared, and used judiciously and with transparency regarding what is collected.

Because your personal data is valuable and sensitive, we want you to be confident that we are handling it with care and respect. We also want to provide you with an understanding of your rights associated with your personal data and options available to you associated with our use of your personal data. This Privacy Notice is part of our effort to achieve these goals.

As you interact with us, you will share your personal data in various ways. Sometimes we collect it directly from you on a voluntary basis, such as when you sign up to receive our monthly newsletter. Other times, we use technology to automatically collect personal data. We also work with third parties with whom we share our users’ personal data.

This Notice applies to our Website (https://www.gybe.eco/), our App (GybeMaps, available by logging in at https://gybemaps.gybe.eco/) (collectively, the Platform), and any sites or products that display these terms. It does not apply to any website, app, mobile app, service, or product that does not display or link to this Privacy Notice or that contains its own privacy notice. If you do not agree with our policies and practices, please do not use our services. By accessing our Website and App, or using our services, you agree to this Notice.

How we collect personal data

We may collect personal data from you directly or indirectly. To complete registration for an account with us or sign up for our newsletters, for example, you provide personal data to us. Once you have an account, you may give additional personal data directly to us. Other times, personal data is collected automatically as you use our Platform. In some instances, third parties with whom we work provide personal data to us, which is used to improve our product and the user's experience. More information about this can be found later on in this Notice.

We collect personal data when you provide it

To get registered with us, you, or our customer (typically, your employer or the organization purchasing access to our database for your use), will need to provide personal data that includes your name, email address, phone number, and other contact information. You also will create a username and password or PIN, information that on subsequent visits helps us confirm your identity and makes it easier to use our App. Along with those basic identifiers, we sometimes collect demographic information that may include a profile photo. We’ll hold onto this personal data until we are directed by our customer to delete it.

You also may provide personal data to us via social media and Web forms, or offline by phone, in person at workshops or conferences, even through regular old postal mail.

We collect personal data from third-party sources

We may collect personal data about you from third parties with whom we work, including our customers, as may be necessary to create accounts for our customers’ employees or designated users to access water quality data through the App. We also may collect personal data from online social networks if you use them to connect with Gybe, or if you take part in a forum, for example, on LinkedIn. We may collect personal data when you click “Share This” or “Like” buttons or otherwise use social media buttons or plug-ins.

You may decline to participate in marketing efforts (which most often occur through email) or not accept our cookies on your internet browser. (For more information, see our cookie policy here.) Keep in mind that declining certain cookies may decrease the functionality of the Website and App or disable some of their features.

We collect personal data using automated technologies 

Sometimes personal data is collected by automated technologies and shared with us when visitors navigate through our Platform. We may track your browsing actions and log your IP address. We may collect data that identifies the device (computer, tablet, phone, etc.) you are using to connect online with us. We also track keystrokes, browsing histories, and searches within the App to make future visits to our Platform more relevant and efficient and to understand what features of our App are most relevant and useful.

Other automated collection technologies – such as cookies, beacons, tags, and scripts – are used by us to analyze trends, administer the Website, and track users’ movements around the Platform. We, and our third-party partners, also use these technologies to gather demographic information about our user base as individuals and in the aggregate. Read more about our use of cookies here.

We will not knowingly collect information from anyone younger
than 16 years old 

We will never knowingly collect personal data from anyone younger than 16 years. If we become aware that personal data of anyone younger than 16 has been provided to us by them, for any purpose, we will delete the information from our files.

Do-not-track requests

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the Do Not Track Signal, their browser sends a message to websites requesting that the user not be tracked. Our Website currently does not respond to “Do Not Track” signals.

How we use personal data

Because your personal data is important to you, we want to be as transparent as possible while explaining how we use that information.

As mentioned above, customers provide names and email addresses when accounts are created for their designated App users. Profiles include user IDs and passwords. Collecting this information allows access to our data and easier, quicker access to our App on subsequent visits. As users navigate through the Platform, their movements will be tracked and analyzed. Doing so allows us to make water data more relevant and easier within the App and to provide relevant and useful information available on our Website.

 

We also use personal data: 

  • To send marketing communications, typically through email.

  • To communicate with customers about their accounts, such as when they want to change their passwords or other account information.

  • To respond to support requests.

  • To provide access to and maintain the security and integrity of the Platform.

  • To provide updates regarding the Platform and marketing information, such as when we develop and improve products and services, or implement feedback polls, etc.

  • To comply with legal and regulatory requirements applicable to our business and internal policies for maintaining records.

  • To protect all parties in the event of disputes.

  • To comply with court orders and legal processes, and to enforce our Terms of Use and this Privacy Notice.

  • For any other legal, business, or marketing purposes that comply with the practices described in this Notice.
     

We sometimes take personal data and strip away identifying details, then combine it into collective data that allow us to predict users’ behavior and interests. In this way, we can fine-tune our marketing campaigns and watershed data. In these cases, the subjects of the personal data remain anonymous.

When we share personal data

Once your personal data is collected, as detailed above, we may share it with third parties for various reasons: web hosting, analytics, and data storage.

Note that when we share your personal data with a third party, we require that third party to protect the information consistent with this Notice and limit its use of the information to performing the services they provide to us.

If you make a public post, other users may see it

If you make a post on a third-party social media site, such as on LinkedIn, or by identifying us in your social media feed by tagging us using a hashtag (#) or “at” (@), your personal data may be publicly available and is subject to the privacy policies of those third-party social media sites. As a reminder, this Notice describes how we will treat your personal data once it is in our possession.

 

We recommend that you review the privacy policies of any third-party sites you visit to understand the data collection and use practices of that third party.

We may share feedback you provide to us

We want to hear how we’re doing. We interview customers to track how and why they are using our products and services, solicit their suggestions, and increase their satisfaction. Please be aware that any feedback relating to our Platform or its content may be publicly shared.

Eventual successors may access information

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, any personal data owned or controlled by us may be among the assets transferred to third parties as successors in interest. As part of this type of transaction, we reserve the right to transfer or assign your personal data to third parties. Other than to the extent ordered by a bankruptcy or other court, or as otherwise agreed to by you, the use and disclosure of all transferred user information will be subject to this Notice.

We need to comply with legal requirements

We may disclose your information to government authorities or other third parties if any lawful circumstances arise, including when:

  • You have given us permission to share your information.

  • We are required to do so by law, or in response to a subpoena or court order.

  • We believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, or to protect our property or other rights or those of other users of the Platform, third parties, or the public at large.

  • We believe that you have misused the Platform by using them to attack or gain unauthorized access to a system or to engage in spamming or other conduct that violates applicable laws or our Terms of Use.


     

How we secure personal data

We have implemented commercially reasonable administrative, physical, and technology-based security measures to protect against loss, misuse, unauthorized access, and alteration of personal data in our systems. This includes use of a third-party authentication service that masks user passwords so that not even Gybe has access to this information. 

 

Additionally, we ensure that any employee, contractor, corporation, organization, or vendor who has access to personal data in our systems is subject to legal and professional obligations to safeguard that personal data.

While we strive to use commercially acceptable means to protect your personal data, no method of transmission over the Internet or form of electronic storage is 100 percent secure. Therefore, we cannot guarantee its absolute security.

Questions or concerns about security or privacy protocols. 

Customers must opt in to receive our email newsletters. However, if you have received unwanted or unsolicited email from us or purporting to be sent by us, please forward a copy of that e-mail with your comments to customer_service@gybe.eco for our review. If you believe that any of our privacy practices or security standards detailed in this Notice have been violated, you may contact us (see Contact Us at the end of this Notice for additional details).

Your Rights

We understand that you want to protect and control your personal data.  This section details how you may review, update, correct, or delete your information.

Updating your personal data  

Due to the nature of our App, customers cannot update their account information on their own. To update your name, contact information, email preferences, or any other account details, please contact us at customer_service@gybe.eco with “Account Update” in the subject line. We will make those changes when allowed or required in accordance with our customer agreements and applicable law.

Deactivating your account

Due to the nature of our agreements with our customers, cannot delete their accounts on their own. To request deletion of an account, please contact us at customer_service@gybe.eco with “Deactivate Account” in the subject line. Upon receiving such a request, we will deactivate the account and delete personal data as required by applicable law.

Opting out of promotional emails

If you do not wish to receive marketing e-mails from us, you may follow the unsubscribe process at the bottom of the e-mail you received or by emailing us at customer_service@gybe.eco. Please keep in mind that you still may receive transactional e-mails from us (such as e-mails related to the completion of your registration, correction of user data, password reset requests, reminder e-mails you have requested, and other similar communications) that may be necessary for us to make the Platform available to you or respond to your inquiries and support requests.

Jurisdiction Specific Rights

1. Platform Users from the European Economic Area, Switzerland, or United Kingdom.

 

Individuals from the European Union, including the United Kingdom and Switzerland, have certain rights associated with their personal data based on applicable law.  Please note that personal data processed by Gybe via our Website is processed by us as a controller (as that term is defined under applicable law) and personal data processed by us via our App is processed by us as a processor (as that term is defined under applicable law) to our customer.  In some cases, particularly when we process your personal data as a processor, we may need to refer you to our customer (the controller) to fulfil your request.

International Transfers

Gybe is headquartered in the United States. Your personal data will be transferred to, processed, and maintained on computer systems located in the United States.

​

The United States currently is not a country the European Union has deemed “adequate” under applicable data protection laws. Gybe collects, transfers, and processes personal data under terms required by applicable law, including: when you provide your consent, to perform a contract with you (such as to make the App accessible), or to fulfil a compelling legitimate interest of Gybe in a manner that does not outweigh your rights and freedoms. Gybe may enter into data protection agreements or other legally approved mechanisms with its vendors to support compliance with applicable law.

We have taken appropriate safeguards to require that the personal data we process will remain protected in accordance with this Notice when transferred internationally, including when processed internationally by third-party service providers and partners. The safeguards we have taken include implementing the European Commission's Standard Contractual Clauses, Binding Corporate Rules or any other legally approved mechanism, for any transfer of personal data to non-EEA third-party service providers or business partners.

Your data protection rights

In addition to any of the general rights granted to you under this Notice, European, United Kingdom and Swiss users have the following data protection rights:

  • You can request access to, correction of, updates to, or request deletion of your personal data.

  • You can object to the processing of your personal data, ask us to restrict the processing, or request portability of your personal data.

  • You have the right to opt out of marketing communications we send at any time. You can opt out by clicking on the “unsubscribe” or “opt out” link in any of the marketing emails we send you.

  • When we have collected and processed your personal data based upon your consent, you can withdraw your consent at any time. However, withdrawing your consent will not affect the lawfulness of any processing we conducted before your withdrawal, nor will it affect processing of your personal data where we have relied on other legal grounds for the processing.

  • You have the right to complain to a data protection authority about our collection and use of your personal data. For more information, please contact your local data protection authority.

Individuals from Brazil have certain rights associated with their personal data based on applicable law. For clarity, personal data processed by Gybe via our Website is processed by us as a controller (as that term is defined under applicable law) and personal data processed by us via our App is processed by us as a processor (as that term is defined under applicable law) to our customer.  In some cases, particularly when we process your personal data as a processor, we may need to refer you to our customer (the controller) to fulfil your request.

3. California Consumer Rights

The California Consumer Privacy Act provides specific rights to those who live in the state of California. This law does not currently apply to Gybe. If you are a California-based consumer, as that term is defined under California law, and have questions based on this section of our Notice, email us at customer_service@gybe.eco or call us at (202) 674-9600.

Be sure to check this Notice for updates, as we will review it at least every 12 months and make necessary changes.

Identity verification requirement

In certain cases, the law requires us to verify that any request submitted was made by someone with the legal right to access the information, but even where the law does not require this, we think it is important for us to do so. Therefore, before accessing or divulging any information pursuant to a data subject access request, we may request that you provide us with additional information so we can verify your identity and legal authority.  

To make a request, please contact us at customer_service@gybe.eco with “Personal Data Request” in the subject line and provide full details about your request, including your contact information and anything you believe is relevant. We will provide a response to an access request within the timeframes required by law. If we cannot substantively respond in a timely manner, we will notify you and provide the reason for the delay.

Under certain circumstances, we may not fulfil your request, such as when doing so would interfere with our regulatory or legal obligations, including customer agreements, when we cannot verify your identity, if your request involves disproportionate cost or effort, or where the law allows us to retain that information. But we will respond to your request within a reasonable time, as required by law, and provide an explanation.

We reserve the right to amend this Notice at any time, for any reason, without additional notice to you, other than through posting the updated Privacy Notice on our Platform.
